Tenant is fixing things themselves and deducting from rent — what now?

Scenario: tenant claims they had to fix [appliance / repair] because landlord didn't respond. They've deducted the cost from the next rent payment.

Is this legal? What's the landlord's response?

Self-help repair deduction is NOT a tenant's right under the RTA, with very narrow exceptions. The tenant generally has to file a T6 to get an abatement or repair order — they can't unilaterally deduct from rent.

**The narrow exception:** emergency repair where the landlord was given reasonable notice and failed to respond. Even then, the LTB has historically required the tenant to file an L application after the fact rather than self-deduct.

**Practical situation:**

The tenant has now technically underpaid rent. That's grounds for an N4. But before serving:

1. **Verify the facts.** Did the tenant actually notify you of the issue first? Did you respond? Was it actually emergent? Was the repair reasonable in scope and cost?
2. **If their case is weak:** serve the N4 for the underpaid amount. They'll have the option to cure within 14 days or you file L1.
3. **If their case has merit (you really didn't respond, the issue was emergent):** offer to reimburse or accept the deduction in writing, with a clear statement that this is a one-time accommodation and future repairs require pre-approval.
4. **Either way: write back in writing.** "Receipt of $X confirms your payment of $Y of the $Z due for [month]. The $ difference is outstanding."

Going forward, include in the next lease renewal (or sign an amendment): "Tenant agrees not to perform any repairs or modifications without landlord's prior written approval. Tenant agrees to immediately notify landlord of any maintenance issues in writing."
