s.49 — Interpretation

49. For the purpose of clause 148 (1) (a) of the Act, the expression “no longer requires the level of care provided by the landlord” includes circumstances where the tenant has repeatedly and substantially withdrawn from participation in some or all of the care services provided by the landlord that are set out in the tenancy agreement, and the tenant is not receiving substantially equivalent community based services.
